Terms and Conditions of Purchase

These terms and conditions of sale (hereinafter referred to as the "Terms") establish the rights, obligations, and responsibilities of the person purchasing products from the online store zvejyboscentras.lt (hereinafter referred to as the "Buyer") and "Žvejybos centras, MB" (hereinafter referred to as the "Seller") when purchasing products from the online store. These e-commerce rules (hereinafter referred to as the "Terms") are an integral part of the purchase and sale agreement. By purchasing products from the online store, the Buyer agrees to the application of these Terms.

1. GENERAL PROVISIONS

  1. The following persons are entitled to use the services of the e-store:

1.1. capable natural persons, at least 18 years of age;

1.2. minors aged 15 to 18, only with the consent of parents, adoptive parents, or guardians, except in cases where they independently dispose of their earnings or scholarship;

1.3. legal entities;

1.4. representatives authorized by all of the above persons.

  1. If the Buyer wishes to use the e-store's services, they must register. Registration is considered completed and valid when the Buyer electronically submits information about themselves, agrees to these Terms, and proceeds to the next steps.

  2. The personal data provided by the Buyer (name, surname, address, phone number, email address) during registration at the e-store will be stored and processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania, No. IX-1296, and these Terms.

  3. The prices of goods listed in the e-store's product catalog are valid only for purchasing these products in the e-store. The prices of products in the e-store include VAT. Delivery prices are not included and are indicated separately when forming the order. The delivery price for the Buyer is clearly shown before order confirmation and is also displayed in the order confirmation.

  4. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer, after forming a shopping cart in the online store, providing the delivery address, choosing the payment method, and reviewing these Terms (by clicking the “I agree with the Terms” button), clicks the “Order” button. The agreement is valid until all obligations under the agreement are fulfilled. If the Buyer disagrees with all or part of the Terms, they cannot place an order. Each agreement concluded between the Buyer and the Seller is stored in the database.

2. BUYER'S RIGHTS

  1. The Buyer has the right to purchase products from the online store in accordance with these Terms and the laws of the Republic of Lithuania.

  2. The Buyer (consumer) has the right to withdraw from the purchase and sale agreement concluded in the online store without providing any reason, by notifying the Seller within 14 days from the date of delivery of the product (except for the exceptions indicated below in this section).

  3. The Buyer's (consumer's) right to withdraw from the purchase and sale agreement concluded in the online store does not apply to the following agreements:

8.1. agreements for products made according to the consumer's specific instructions, which are not pre-made and are manufactured based on the consumer's personal choice or specification, or for products clearly tailored to the specific needs of the consumer;

8.2. agreements for sealed goods that were unpacked after delivery and are unsuitable for return due to health protection or hygiene reasons (e.g., underwear);

8.3. agreements for sealed video or audio recordings or sealed software that was unpacked after delivery or whose packaging was damaged;

8.5. The Buyer has no right to withdraw from the agreement if the product was damaged or its appearance changed significantly. Changes to the packaging's appearance necessary to inspect the received product are not considered as significant changes to the product's appearance.

3. BUYER'S OBLIGATIONS

  1. The Buyer must pay for the goods and their delivery, as well as any other payments (if specified in the agreement) and accept the ordered products.

  2. The Buyer must provide complete and accurate data in the e-store registration form. If the Buyer's registration data changes, the Buyer must update it immediately.

  3. The Buyer assumes all risk arising from failing to update personal data on time.

  4. The Buyer undertakes not to disclose their registration and login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller by email at info@zvejyboscentras.lt. The Seller is not responsible for actions performed by third parties using the Buyer's login details until the Seller has been informed of the loss of the login details.

  5. The Buyer must comply with other requirements set forth in these Terms and the laws of the Republic of Lithuania.

4. SELLER'S RIGHTS

  1. If the Buyer attempts to damage the e-store’s operation or stable functioning, the Seller may, without prior warning, limit or suspend the Buyer’s access to the e-store and is not responsible for any related damages incurred by the Buyer.

  2. The Seller has the right to unilaterally amend these Terms by publishing them on the e-store website. Changes take effect from the moment they are published for all transactions made after the publication.

  3. The Seller has other rights provided in these Terms and the laws of the Republic of Lithuania.

5. SELLER'S OBLIGATIONS

  1. The Seller undertakes to provide the Buyer with the opportunity to properly use the services provided by the e-store.

  2. If there is a temporary shortage of goods, and the Seller cannot deliver the ordered goods to the Buyer, the Seller undertakes to offer the Buyer a similar product. If the Buyer refuses to accept (purchase) the substitute product, the Seller undertakes to refund the money paid within 3 (three) working days.

  3. The Seller undertakes to comply with other requirements set forth in these Terms.

  4. The Seller guarantees the quality of the products.

6. PAYMENT FOR GOODS

  1. The Buyer may pay for the goods:

21.1. using online banking systems;

21.2. by prepayment via bank transfer;

21.3. in cash;

7. DELIVERY OF GOODS

  1. Goods are delivered at the Buyer's expense by transport companies, courier services, or postal services.

  2. When paying for the goods using the payment methods specified in sections 21.1 and 21.2 of these Terms, the goods located in the Seller’s warehouse in the territory of the Republic of Lithuania will be delivered within 1-7 working days, and to foreign countries within 7-14 working days from receiving the payment for the goods and transport services.

  3. When choosing the payment method specified in section 21.3 of these Terms, goods located in the Seller’s warehouse in the Republic of Lithuania will be delivered within 1-7 working days from the Buyer's order confirmation.

  4. During delivery, the Buyer or the Buyer's representative must check the condition of the package, the quantity, quality, and assortment of the products together with the representative of the delivery company.

  5. If damage to the package, discrepancy in quantity, quality, or assortment of goods is found, the Buyer or the Buyer’s representative must refuse to accept the shipment. In this case, the delivery company’s representative, together with the Buyer or their representative, will fill out a special inspection report that indicates the found damages.

  6. If the goods are accepted by someone other than the Buyer, the Buyer must specify the person who will receive the goods in the order’s delivery information.

  7. The Buyer may choose not to order delivery services and pick up the purchased goods from the Seller’s store in Kaunas.

8. WARRANTY FOR GOODS

  1. All goods are subject to the manufacturer's warranty or the warranty terms set by the laws of the Republic of Lithuania.

  2. If the Buyer purchases a defective product, they have the right to choose:

31.1. to have the defective item replaced with a suitable item;

31.2. to have the purchase price of the item reduced accordingly;

31.3. to request that the Seller repair the defective item within a reasonable time;

31.4. to return the paid money and cancel the contract.

9. RETURN OF GOODS

  1. The Buyer (consumer) has the right to withdraw from the purchase and sale contract, notifying the Seller in writing within 14 days from the date of delivery under the following conditions:

33.1. The Buyer must return the goods to the Seller at their own expense if they wish to return the product for reasons other than the product being defective or an order mistake.

33.2. The product must be returned in its original packaging, undamaged, and unused (with the label, instructions, and warranty card, if provided with the product).

33.3. The Buyer is responsible for the proper packaging of the returned product. If the product is not properly packaged, damaged, or significantly altered in appearance, the Seller has the right to refuse the return.

  1. The Seller, after inspecting the returned product and accepting it, will refund the Buyer the price of the product no later than 4 working days from the acceptance of the returned product.

  2. If a defective product is returned, the Seller undertakes to accept the defective product and replace it with a suitable one within 14 working days from the date of purchase. If the Buyer refuses to accept the replacement of the defective product with a suitable one, the Seller will refund the Buyer the paid price within 3 working days from the return of the defective product.

10. PARTIES' RESPONSIBILITIES

  1. The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer assumes responsibility for any consequences arising from the inaccuracy or incorrectness of the data provided in the registration form.

  2. For any violation of the purchase and sale agreement made using the e-store, the parties are liable in accordance with the laws of the Republic of Lithuania.

  3. In accordance with Article 8, part 3 of the Lithuanian Republic’s Electronic Signature Law, the Buyer and the Seller agree that the Buyer’s actions in the e-store, confirmed by logging in with their electronic store credentials (recognition code), have the legal effect of an electronic signature under Article 8, part 1 of the Electronic Signature Law (i.e., they have the same legal effect as a handwritten signature and can be used as evidence in court). The Buyer must protect their e-store login details and not disclose them to anyone, ensuring the data is known only to them, and the data is used only by them. If the Buyer suspects their login details have been discovered by another person, they must immediately notify the Seller and also inform the Seller about any breach or disclosure of login data.

  4. The Seller is not responsible for information provided on the websites of other companies, even if the Buyer accesses these websites through links on the Seller's e-store.

  5. The Seller is not responsible for the color, shape, or other parameters of the products presented in the e-store, which may differ from the actual product size, shapes, and colors due to the Buyer’s display characteristics.

11. PERSONAL DATA PROCESSING

  1. By registering at the e-store, the Buyer confirms that they and/or their representatives agree to provide the Seller with the personal data indicated in these Terms and the registration form and do not object to the processing of this data by the Seller for online trading purposes.

  2. By registering at the e-store, the Buyer confirms that they and/or their representatives agree that their personal data will be provided to third parties chosen by the Seller to process this data for online trading purposes as described in the next section.

  3. By registering at the e-store, the Buyer confirms that they and/or their representatives agree to present one of the identity documents (passport, ID card, or new driver's license) to the Seller or the third party delivering the goods in order to properly identify the Buyer and/or their representatives for online trading purposes.

  1. By registering at the e-store, the Buyer confirms that they and/or their representatives agree to the Seller processing their personal data for direct marketing purposes. The Seller specifies that personal codes of the Buyer (if they are a natural person) and their representatives will not be processed for direct marketing purposes.

  2. By registering at the e-store, the Buyer confirms that they and/or their representatives are informed of their right to access the personal data processed by the Seller and how it is processed, to request corrections, destruction of their personal data, or suspension of the processing of their personal data when the data is processed in violation of the law, and to object to the processing of their data for any purpose.

  3. By registering at the e-store, the Buyer confirms that they and/or their representatives know they have the right to refuse to provide their personal data but understand that the data is necessary and required to uniquely identify the Buyer and/or their representatives for online trading purposes. Without providing personal data and/or agreeing to the processing of this data, the Buyer will not be able to conclude and/or execute the agreement.

12. INFORMATION PROVISION

  1. The Seller sends all notifications to the email address provided by the Buyer in the registration form.

  2. The Buyer sends all notifications and inquiries to the address specified in the "Contacts" section of the Seller's e-store.

13. FINAL PROVISIONS

  1. The Seller reserves the right to suspend, update, or amend these Terms and other related documents at their discretion, notifying the Buyer in the e-store. The amendments to the Terms take effect from the moment they are published on the e-store system.

  2. If the Buyer disagrees with the new version of the Terms, partial amendments, or changes, they lose the right to use the e-store services.

  3. If after the changes to the Terms, the Buyer continues using the services of the e-store, it is considered that the Buyer agrees with the new version of the Terms and the partial changes or additions.

  4. These Terms do not limit the rights of the Buyer (consumer) established by the laws of the Republic of Lithuania, including the rights related to the purchase of products or services of poor quality.

  5. Any disputes arising from the implementation of these Terms will be resolved through negotiations. If an agreement is not reached within 30 (thirty) days, disputes will be resolved in accordance with the laws of the Republic of Lithuania.

Note: In all cases, customers are first requested to contact MB "Žvejyboscentras" (i.e., the seller).

  7. Lithuanian law applies to these Terms.
